Small Claims Court Lawsuit for Statutory Violations
2308.404 allows a vehicle owner or operator the right to file a Small Claims Court Lawsuit against the Property Management Company, business owner and landowner for any statutory violation of the Texas Occupational Code 2308, which regulates the booting, towing and vehicle storage facility law.
The amount of damages that can be sought are $1000.00 plus three times the amount paid to the Storage Facility to release the unit or the drop fee paid to the Towing Company, plus the filing fees and evidence production.
